In California, the Labor Code entitles employees to certain protection. At the most basic level, employees are entitled to the following rights:

- An employee is entitled to minimum wage. In California, the rate is currently $15.50 an hour, but some cities like Los Angeles or Santa Monica have passed ordinances setting the minimum wage higher.
- An employee is entitled to overtime pay whenever that person works more than 8 hours a day or 4 hours a week. Minimum wage is paid at 1 1/2 times an employee regular rate.
- An employee is entitled to a 10 minute paid break for every 4 hours worked, or a fraction thereof. This is a paid break, so employees don’t need to clock out.
- An employee is entitled to at least a 30 minute lunch break for every 5 hours worked. During this lunch break, the employee must be relieved of all duties and is free to leave the work premises.
